Terms and Conditions

The General Terms of Use constitute an integral part and a prerequisite for the following General Terms and Conditions of Sale.

  1. CUSTOMER REQUIREMENTS

    • To place orders on the website www.minobossi.it (the Site), Customers must:

      1. Have accepted the Site's Terms of Use, Privacy Policy, and these General Terms and Conditions of Sale;
      2. Be at least 18 years old;
      3. Possess the necessary requirements to enter into legally binding contracts;
      4. Have a valid email address;
      5. Have a valid credit card for payment.
    • In light of the above, EXIN reserves the right not to accept orders from Customers who do not meet these requirements. Furthermore, orders destined for non-enabled countries cannot be fulfilled.

    • These Conditions can be printed or saved in accordance with Article 12 of Legislative Decree 70/2003 (as amended by subsequent amendments) and Article 50 of Legislative Decree 206/2005 as amended by Legislative Decree 21/2014.

  2. PRODUCT INFORMATION AND IMAGES

    • For each Product for sale, images, descriptions containing the main features, measurements, and price (VAT included) are available.

    • The descriptions and information about the Products on the Site are intended to provide a service to our customers. They are purely informational and may not perfectly and exactly represent the product's characteristics.

    • EXIN disclaims any responsibility for the possible non-conformity of the colors of purchased products compared to those displayed on the Customer's monitor/screen when this is due to particular configurations and/or malfunctions of the latter.

    • EXIN disclaims any responsibility for any inaccuracies which, if reported, will be promptly corrected.

    • The Customer is aware that the characteristics of each product are those provided by EXIN, with the tolerance imposed by the use of handcrafted materials and non-industrial processing methods.

    • The Customer acknowledges that, during production, suppliers may decide to make changes to the raw materials, so there may be tolerable discrepancies with the product depicted in the Site's image. If such differences are significant, EXIN will notify the Customer.

  3. PRICES AND PAYMENT METHODS

    • Prices published on the site, payments, receipts, and invoices for orders are exclusively in Euros.

    • Prices are inclusive of VAT.

    • Any shipping costs or payment fees are communicated to the Customer through the Site.

    • EXIN reserves the right to change the price of products at any time without notice.

    • The Customer must ensure the final sale price before submitting the order proposal.

    • Each order includes a detailed breakdown of the value of each product purchased and the total amount.

    • Sale items will be listed in the invoice exclusively with the final discounted price.

    • EXIN accepts only the following payment methods:

      1. Credit Card
      2. Paypal
    • All transactions are processed through a secure server, ensuring the highest protection of customer data.

    • No fees will be charged for using the above payment methods, except in expressly established cases, rates exceeding those incurred by the company.

    • In the case of credit card purchases, financial information will be sent via encrypted protocol to the entity providing remote electronic payment services. This information will be used by EXIN only to complete the purchase or for any refund procedure in case of return following the exercise of the right of withdrawal or to report to the competent authorities any commission of fraud. EXIN will not store such data and cannot be held responsible for any fraudulent and improper use of payment cards by third parties at the time of payment.

    • EXIN sales personnel are not authorized to request or accept credit card numbers or validity details.

    • To ensure greater protection for e-commerce purchases, EXIN recommends that its Customers join Verified By Visa or Mastercard Securecode services or contact their credit institution for information in this regard.

  4. PURCHASE PROCESS, ORDER FULFILLMENT, AND SHIPPING

    • To place an Order, the Customer must follow the procedure indicated on the Site, providing all necessary data.

    • During the purchase process and before its completion, the Customer may request the issuance of an invoice by providing all necessary fiscal data. In the absence of this, the invoice cannot be requested or issued later.

    • The purchase process begins with the submission of the order proposal by the customer.

    • The submission of the Order Proposal to the Seller does not constitute a binding purchase proposal.

    • EXIN will send the Customer an email to confirm receipt of the Order Proposal. This email contains a summary of the products included in the Order Proposal so that the Customer can review it.

    • If EXIN detects a recognizable error in the indication of a product’s price or in the calculation of the payment amount, it will not accept the Order Proposal and will contact the Customer via email to offer the opportunity to submit the purchase order proposal for the product(s) at the correct price.

    • Only after verifying the completeness of the data entered by the Customer and the actual availability of the requested products, EXIN will process the order within 7 working days.

    • Once the order is processed, the goods will be prepared for shipment, and EXIN will send the Customer an order confirmation email with the courier's details and tracking number. Only upon receipt of this final email by the Customer can the contract be considered concluded for the products specified therein.

    • EXIN reserves the right to refuse Order Requests:

      1. Whose data is incomplete or incorrect;
      2. Where there are insufficient solvency or legitimacy guarantees for the operation;
      3. When payment fails or the Customer's Bank is unable to receive verification from the Customer's bank.
    • If the funds available on the selected payment method are sufficient for the purchase and the details, including banking details, provided are valid, EXIN will accept the order upon receipt of confirmation from the bank of the completed transaction.

    • Once the order is accepted, the Customer cannot modify or cancel it for products made to measure or customized.

    • Orders comprising multiple products may be fulfilled separately at EXIN's discretion.

    • Technical problems, service disruptions from suppliers, or orders placed by different Customers at the same time may cause discrepancies in stock. EXIN therefore reserves the right to reconfirm the availability of items subject to the order request.

    • If the requested items are no longer available or if the order cannot be fulfilled for any reason, EXIN will promptly notify the Customer via email.

    • In case of non-compliance with the maximum delivery term of 30 days, the Customer must send an invitation to make the delivery within an appropriate additional period given the circumstances to the email address contact@minobossi.it. If the additional period expires without the goods being delivered, the Customer is entitled to terminate the contract.

    • As an alternative to shipping, the Customer may choose to collect the purchased products directly from the Seller’s premises. The day from which the product is available for collection will be communicated to the Customer via email. The Customer will have 15 days from receipt of the email to collect the product. After this period, the Product will be shipped to the Customer with shipping costs borne by the recipient.

    • Shipping is carried out via courier chosen by EXIN.

    • Shipping costs vary depending on the destination.

    • Shipping will be made to the address indicated in the "shipping address" field in the purchase order. No other address will be considered valid.

    • Orders placed during weekends and public holidays (January 1, January 6, Easter and Easter Monday, April 25, May 1, June 2, summer closure periods in August, variable depending on the year, November 1, December 8, and December 25-26) will be processed starting from the first working day thereafter.

    • In all cases, EXIN reserves the right to postpone shipping if events and/or force majeure causes occur.

    • EXIN is not responsible, in any case, for delays due to couriers, customs operations, or force majeure events or other circumstances not dependent on EXIN.

    • When the Order is shipped, EXIN will send an email to the Customer containing the tracking number to monitor the shipment’s progress.

    • Upon arrival of the goods, Customers are requested to carefully inspect the package before signing for receipt of the shipment.

    • EXIN packages are wrapped in a cover and sealed with adhesive tape.

    • If the package appears tampered with or if the adhesive tape is not intact, the Customer is required to sign for receipt "with reserve" and immediately report the occurrence to the courier and contact EXIN at the email address contact@minobossi.it

    • All Customers who place an Order agree to accept the delivery of their package.

    • If the package is not delivered due to issues attributable to the Customer (incorrect address, recipient always absent, incorrect phone number, refusal, etc.), shipping and reshipping costs as well as any customs duties will be borne by the Customer in any case.

  5. RETURNS AND REFUNDS

    • If for any reason the Customer is not satisfied with their purchase, they may exercise the right of withdrawal within 14 working days following receipt of the goods.

    • The right of withdrawal is not exercisable for customized and/or made-to-measure products.

    • Within 14 working days following the exercise of the right of withdrawal, the Customer must return the products to EXIN for which they have exercised the right of withdrawal.

    • The right of withdrawal and consequent return of products are subject to the following conditions:

      1. All products must still have the MINOBOSSI security tags in their original position and must be intact, unused, and unaltered.
      2. The Customer must include the original packing slip and a copy of the return request confirmation.
      3. Any free gifts received must also be returned.
      4. The returned items must be in a single shipment, and each shipment must contain all items to be returned in a single shipment. Products purchased in different orders cannot be returned together.
      5. The Customer is responsible for shipping costs related to the return of products. EXIN does not accept returns with shipping costs borne by EXIN.
    • In cases where the Customer has not complied with the above return conditions, the returned product will not be accepted, and the Customer will not be refunded.

    • In case of a valid return, EXIN will issue a refund corresponding to the value of the returned products. The refund will be made as soon as possible and no later than 14 days from the day EXIN receives the returned products. The refund will be issued to the same payment method used for the initial order.

    • EXIN may request the Customer to provide evidence of return in case of delays in receiving the package.

  6. EXCHANGES

    • If the Customer wishes to exchange a product with another one, they should return the item and place a new order for the desired product.

    • Exchanges cannot be made directly.

  7. WARRANTY AND CUSTOMER ASSISTANCE

    • All products sold are covered by a legal warranty for defects in conformity as provided by current legislation (Legislative Decree 206/2005 as amended by Legislative Decree 21/2014). The warranty applies exclusively to faults in conformity existing at the time of delivery of the product.

    • The warranty does not cover defects resulting from misuse of the product, wear and tear, or improper maintenance.

    • To make a warranty request, Customers must contact EXIN customer service at contact@minobossi.it, describing the defect and attaching any photos or videos that may help assess the issue.

    • EXIN will assess the warranty request and provide instructions on how to return the product if the defect is confirmed.

    • In case of a valid warranty claim, EXIN will repair or replace the defective product, or if that is not possible, provide a refund.

    • EXIN reserves the right to verify the defect of the product and may request further documentation or evidence.

  8. PRIVACY AND DATA PROTECTION

    • EXIN processes personal data in accordance with current privacy laws. For more details, refer to the Site's Privacy Policy.
  9. APPLICABLE LAW AND DISPUTE RESOLUTION

    • These General Terms and Conditions of Sale are governed by Italian law.

    • For any disputes arising from the interpretation, execution, and enforcement of these General Terms and Conditions of Sale, the competent court is the Court of Milan, Italy.

    • The Customer has the right to access the European Online Dispute Resolution platform (ODR) to resolve any disputes related to the purchase of products through the Site. For more information, visit the European Commission's ODR platform.
